"IBC's performance related to NPA of public sector banks compared to other tools: Lok Adalat (2018-19) 40.89 lakh cases referred; Rs.2,816 crore ( 5.3%) recovery; in DRT, there were 10,574 cases with only 3.5% recovery; in SARFASI: with over 2 lakh cases, only Rs.41,876 crore (14.5%) was recovered. Under IBC, recovery rate is 42.5%," she informs the House.
"This Code is not a recovery law," she added, "MSMEs have several other ways through which they can recover their claims".

Nirmala Sitharaman replies in debate on Insolvency Code
Finance Minister Nirmala Sitharaman on Monday said that the Insolvency and Bankruptcy Code (Second Amendment) Bill, 2020 has been brought in to provide "immediate relief" to companies.
"On the Bill, she says the ordinance brought on 5 June was a timely ordinance, which clearly suspended the application of three sections (7,9 and 10) of the Code," The Hindu reported, quoting her as saying, "We had to prevent any company, stressed because of COVID, from being pushed into insolvency".
"We did not want to hurt any other proceedings initiated before March 25 due to the reasons apart from those associated with the COVID-19 fallout," she added.

India's imports from China dip 27.63% during Apr-Aug: Piyush Goyal informs Parliament
India's imports from China declined by 27.63 percent during April-August this fiscal to USD 21.58 billion over the same period previous year, Parliament was informed on Monday.
Value of imports from China stood at USD 4.98 billion in August and USD 5.58 in July, according to the data provided by Commerce and Industry Minister Piyush Goyal in his written reply to the Lok Sabha.
"India's imports from China have declined by 27.63 per cent during April-August, 2020-21 over the corresponding period of the previous year," he said. In a separate reply, the minister said there is no proposal under consideration on withdrawal of Most Favoured Nation (MFN) status to China.

Mamata Banerjee speaks to suspended RS MPs, lauds their efforts
West Bengal Chief Minister Mamata Banerjee Monday spoke to the eight Rajya Sabha MPs who have been suspended from Parliament over the protests against the farm Bills, and appreciated their efforts towards "upholding the values of Parliament".
The MPs, who are now holding a protest against their suspension along with Opposition lawmakers from across parties, were suspended a day after the Upper House witnessed unprecedented unruly scenes during the passage of the two crucial farm Bills.
The WB chief minister spoke to the MPs for 10 minutes and in her conversation with them appreciated their efforts in fighting against farmer Bills, labour Bills and upholding the values of Parliament, a senior Trinamool Congress leader told PTI.
Banerjee, who in the morning condemned the government for its action, also released an audio clip in which she came down hard on the BJP, alleging the party is making an all out effort to make states powerless and itself all powerful.

Need to save companies to save jobs: BJP MP on IBC Act
BJP MP Nishikant Dubey, BJP, said NPAs to the tune of Rs.14 lakh crore was a result of the decisions taken under the Congress-led government, adding that the entire banking system was in a disarray when the NDA came to power.
"The banks could earlier recover dues through the Lok Adalat system, only 5.3% recovery was made through this system in 2018, just about 3% recovery was made through the Debt Recovery Tribunal route. However, the Code's recovery rate is about 42.5%.
"Isn't there a need to save companies to save jobs? As per an estimate, the world over 5% jobs will be lost amid the COVID-19 crisis." he asked.

Govt hikes wheat MSP by Rs 50 to Rs 1,975 per quintal
The government on Monday hiked the minimum support price of wheat by Rs 50 per quintal to Rs 1,975 per quintal to encourage farmers to increase cultivation of the crop.
The decision was taken at a meeting of the Cabinet Committee on Economic Affairs (CCEA) chaired by Prime Minister Narendra Modi and was announced by Agriculture Minister Narendra Singh Tomar in Lok Sabha.
The announcement comes in the backdrop of widespread protests by Opposition parties as also by farmer groups in Punjab, Haryana and some other states after Parliament passed two key farm bills on Sunday, which the government says will give farmers'' marketing freedom and better price for their produce.
The Farmers' Produce Trade and Commerce (Promotion and Facilitation) Bill, 2020 and The Farmers (Empowerment and Protection) Agreement of Price Assurance and Farm Services Bill, 2020 were passed by Parliament.
Tomar said that the CCEA has approved increasing MSP of six rabi crops. Wheat MSP has been increased by Rs 50 per quintal to Rs 1,975 per quintal.
The announcement comes in the backdrop of protests by Opposition parties and the farmer groups in Punjab, Haryana and some other states after Parliament passed two key farm bills on Sunday.

Amit Shah likely to move Bill amending Foreign Contribution (Regulation) Act
Union Home Minister Amit Shah expected to move the Bill to amend the Foreign Contribution (Regulation) Act, for consideration in Lok Sabha.
The Centre on Sunday proposed amendments to the Foreign Contribution Regulation Act, or FCRA, to make Aadhar mandatory for all office bearers of non-governmental organisations that seek foreign contributions. The proposed stringent amendments also seek to bar public servants from receiving foreign funding.
This means any person who makes an application for prior permission, seeks registration under the FCRA, or wants to renew their FCRA licence, would first have to mandatorily furnish the Aadhar numbers of all office bearers, directors or other key functionaries.

What is The Factoring Regulation (Amendment) Bill, 2020?
Lok Sabha will on Monday take up a bill to amend the Factoring Regulation Act that seeks to help micro, small and medium enterprises by providing additional avenues for getting credit facility. The Factoring Regulation (Amendment) Bill was introduced in the lower house on 14 September.
The Factoring Regulation Act, 2011 was enacted to provide for regulating the assignment of receivables to factors, registration of factors carrying on factoring business and the rights and obligations of parties to the contract for assignment of receivables.
"The amendments are expected to help micro, small and medium enterprises significantly by providing added avenues for getting credit facility, especially through Trade Receivables Discounting System.
"Increase in the availability of working capital may lead to growth in the business of the micro, small and medium enterprises sector and also boost employment in the country," according to Statement of Objects and Reasons of the bill. On Sunday night it was wrongly reported that the bill has been passed.

Indian citizenship granted to 2,120 Pakistanis, 99 Bangladeshis in last 4 yrs; Centre tells RS
A total of 2,120 Pakistanis, 188 Afghans and 99 Bangladeshis were granted Indian citizenship in the last four years, the Rajya Sabha was informed on Monday.
Union Minister of State for Home Nityanand Rai said a total of 2,729 people of 44 nationalities were granted Indian citizenship from 2017 till 17 September, 2020.
Apart from 2,120 Pakistani, 188 Afghanistan and 99 Bangladeshi nationals, as many as 60 American, 58 Sri Lankan, 31 Nepali, 20 British, 19 Malaysian, 14 Canadian and 13 Singapore nationals were also granted Indian citizenship during the same period, he said in a written reply.

Farm bills not against mandis, says PM Modi
Congratulating farmers in the passage of two farm Bills by the Parliament on Sunday, Prime Minister Narendra Modi said these changes in the agricultural sector is the need of the hour.
"These Bills will empower the farmers to freely trade their produce anywhere. I want to make it clear that these Bills is not against the agriculture mandis. I also want to assure every farmer that the Minimum Support Price system will continue as before," he said.
Modi further added that during the coronavirus pandemic, record purchase of wheat has been made from farmers during the Rabi season. "Rs 1 lakh 13 thousand crores were given to the farmers at MSP. This amount is 30 percent more than last year," he said.

Parliament LATEST Updates: The Rajya Sabha will continue discussion on the The Indian Institutes of Information Technology Laws (Amendment) Bill, 2020, which could not be conducted on Monday even as protests were witnessed in the Opposition Benches over the suspension of eight MPs.
The House will also see the introduction of The Essential Commodities (Amendment) Bill, 2020, a proposed legislation that has been in contention along with the two farm Bills that have led to protests in the PArliament ever since their introduction in the Lok Sabha last week.
Finance Minister Nirmala Sitharaman will move motions for the consideration and passage of The Banking
Regulation (Amendment) Bill, 2020, The Companies (Amendment) Bill, 2020, The Taxation and Other Laws (Relaxation and Amendment of Certain Provisions) Bill, 2020, The Appropriation (No.3) Bill, 2020 and The Appropriation (No.4) Bill, 2020.
Other proposed legislations on the Rajya Sabha's List of Business are The National Forensic Sciences University Bill, 2020 and The Rashtriya Raksha University Bill, 2020.
Meanwhile, according to Lok Sabha's List of Business, consideration and passage of The Occupational Safety, Health And Working Conditions Code, 2020, The Industrial Relations Code, 2020, The Code On Social Security, 2020 and The Factoring Regulation (Amendment) Bill, 2020 are on the agenda.
The sit-in protest in front of the Parliament Complex's Gandhi statue by eight suspended MPs on Monday continued past midnight. Senior opposition leaders, including NC leader Faroukh Abdullah, JD(S)' HD Deve Gowda, Samajwadi Party's Jaya Bachchan, Congress’ Ahmed Patel and NCP's Praful Patel, paid a visit to the MPs.
After witnessing ruckus despite reconvening after the fifth adjournment for the day on Monday, the Rajya Sabha was adjourned till Tuesday, even as eight suspended MPs refused to leave the House. They were suspended by Chairman Venkaiah Naidu for unruly behaviour, who also dismissed the no-confidence motion against deputy chairman Harivansh Singh.
The Lok Sabha passed Homoeopathy Central Council (Amendment) Bill, 2020, and Indian Medicine Central Council (Amendment) Bill, 2020 in proceedings that continued past midnight.
These Bills were moved for passage after the House passed the Epidemic Diseases (Amendment) Bill, 2020 that seeks to bring a law that punishes those who attack health workers or doctors who are fighting the coronavirus outbreak or during any situation similar to the current COVID-19 pandemic. The Lower House also passed the FCRA Amendment Bill, 2020.
